华侨权益保护法刍议：

试论华侨身份认定制度的系统构建^*

摘 要 随着世情、国情和侨情发生重大变化，华侨在我国参与社会事务的过程中遇到不少困难，主要原因是华侨难以证明其中国公民身份。为减少立法成本，有必要在《华侨权益保护法》中专门系统地构建华侨身份认定制度，以切实保障华侨合法权益。《华侨权益保护法》在协调各个规范性文件之间的冲突的同时，应设计出包括华侨身份的认定原则、认定主体、认定标准、认定程序、认定后的形式与功能、认定救济、认定后制度的常规维护机制等方面的华侨身份认定制度。

Abstract: With the rapid development of world situations，national situations and overseas Chinese situations, overseas Chinese encounter many difficulties when they participate in the social affairs in China, in the social affairs in China which is mainly due to they are not able to prove their Chinese nationality conveniently. In order to reduce the cost of legislation, it is necessary to establish a system of overseas Chinese identity recognition in the Law on the Protection of Rights and Interests of Overseas Chinese, and to protect the legitimate rights and interests of overseas Chinese. The law is to not only coordinate the clashes between various normative documents but also to enact mechanism for overseas Chinese identity cognizance including principle, subject, standards, procedures, form or function, relief and routine maintenance.
